Title: Invitation to Tender for Dedicated KU & KA Band VSAT Internet Subscription
Preamble
Mercy Corps (MC) Maiduguri (MDG) Field Office is requesting quotations from Internet Service Providers (ISP) to provide Internet bandwidth subscription service on KU & KA Band Very Small Aperture Technology (VSAT) for our Deep Field Offices (DFOs) in Bama, Damboa, Dikwa, Gwoza and Ngala LGA. Service required is for a period of 12 months.
Scope of Works
Purpose / Service Description:
KU Band VSAT Internet Service Subscriptions (Primary source of Internet services in the Deep Field Offices):
- The service required from successful ISP is to deliver 4 Mbps download by 1 Mbps upload capacity (speed) on Ku Band VSAT for each site. The bandwidth to be delivered shall be a dedicated service with each DFO on a dedicated service.
- The service shall be provided along with equipment supply, shipment, delivery, installation, and commissioning (leased network infrastructure) of 5 Ku Band VSAT consisting of 5 Out-Door Units (ODU) of 1.2 /1.8M Dishes/3-6Watt Low Noise Blockers (LNBs) 5 In-Door Units (IDU) of 5 modems at Bama, Damboa, Dikwa, Gwoza and Ngala.
Service Provider Objectives:
- Deliver 12-month dedicated bandwidth subscription service of 4/1 Mbps on existent infrastructure to five (5) MC Deep Field Offices in Bama, Damboa, Dikwa Gwoza & Ngala LGAs - Borno State
- Deliver to each DFO based on specified bandwidth, a minimum speed of 4 Mbps download by 1 Mbps upload throughout the duration of service agreement.
- Deliver to each DFO a link maximum latency of 900 milliseconds for the duration of service agreement.
- Deliver consistent Internet access in accordance to network ethics throughout the duration of service agreement.
- Deliver 24/7 service support on the link for the duration of service contract with Service Level Agreement (SLA) of 1 hour for minor link down-times, and a maximum 72 hours for critical ISP equipment failures.
Service Provider Activities:
The ISP will:
- Obtain coordinates of MC Bama, Damboa, Dikwa, Gwoza and Ngala DFOs for Ku Band VSAT ODU installation
- Carry out installation of ODUs at MC Bama, Damboa, Dikwa, Gwoza and Ngala DFOs and lock to ISP Hub satellite.
- Install and configure MC Bama, Damboa, Dikwa, Gwoza and Ngala DFOs modems
- Test links for Signal Noise Ratio (SNR), Internet connectivity and bandwidth (speed).
- Hand over links to MC NE Senior ICT Officer with appropriate sign-off documents.
KA VSAT Internet Subscription (Back-up internet services in the Deep Field Offices):
- The service required from successful ISP is to deliver 4 Mbps download by 2 Mbps upload capacity speed) on KA Band of VSAT across 5 sites. The bandwidth to be delivered shall be a dedicated service shared on a Contention Ratio (CIDR) of 1:5 across 5 DFOs on a dedicated 4/2 Mbps pipe).
- The service shall be provided on a leased network infrastructure of 5 KA Band VSAT consisting of 5 Out-Door Units (ODU) of a minimum 1.2M Dishes/3-6Watt Low Noise Blockers (LNBs) and 5 InDoor Units (IDU) of 5 modems
Service Provider Objectives:
- Deliver 12-month dedicated bandwidth subscription service of 4/2 Mbps shared across leased infrastructure to 5 MC DFOs.
- Deliver to each DFO based on contention ratio, a minimum speed of 1 Mbps download by 0.5 Mbps upload during peak periods with bursts of 4 Mbps download by 2 Mbps uploads throughout the duration of service contract.
- Deliver to each DFO during off-peak periods, a speed of up to 4 Mbps download by 2 Mbps upload for the duration of service contract.
- Deliver consistent Internet access in accordance to 99.999% (“five nines”) link uptime network ethics throughout the duration of service contract.
- Deliver 24/7 service support on the link for the duration of service contract.
Supplier Eligibility
Suppliers may not apply, and will be rejected as ineligible, if they:
- Are not registered companies
- Are bankrupt or in the process of going bankrupt
- Have been convicted of illegal/corrupt activities, and/or unprofessional conduct
- Have been guilty of grave professional misconduct
- Have not fulfilled obligations related to payment of social security and taxes
- Are guilty of serious misinterpretation in supplying information
- Are in violation of the policies outlined in Mercy Corps Anti Bribery or Anti-Corruption Statement
- Supplier (or supplier’s principals) are on any list of sanctioned parties issued by; or are presently excluded or disqualified from participation in this transaction by: the United States Government or United Nations by the United States Government, the United Kingdom, the European Union, the United Nations, other national governments, or public international organizations.
Specific Eligibility Criteria
In keeping with Mercy Corps’ guiding principle for procurement, Mercy Corps Nigeria Uses only responsible service providers that possess the ability to perform successfully under the terms and conditions of a proposed procurement. In addition to the ability to perform, Mercy Corps also consider minimum standards of responsibility to determine which Service provider(s) Mercy Corps will do business with. These standards include:
- Being eligible business under applicable laws and regulations of the Federal Republic of Nigeria
- Being in good standing with any taxation or legal authority in Nigeria
- The business must be registered and incorporated under the laws of Nigeria with corporate Affairs Commission (CAC)
- The business must be registered with CAC and FIRS and has a Tax Identification Number (TIN) and EFCC certificate
- The business must have a valid address
- The business is not bankrupt or in the process of going bankrupt
- The business/owners have not been convicted of an offence concerning professional conduct
- The business/owners have not been guilty of grave professional misconduct (proven by any means that the contracting authorities can justify).
- The business have fulfilled obligations related to payment of social security and taxes
- The business is not guilty of serious misinterpretation in supplying information
- The business is not in situation of conflict of interest (with prior relationship to project or family or business relationship to parties on commission)
- The business does not employ personnel below the legal working age.
- The business provides basic social right and fair working conditions to the employees.
- The business/Owners are not on any list of sanctioned parties issued by the United States Government and/or United Nations and European Union.
Tender Submittals
Documents and required information listed in tender submittals are necessary in order to support the eligibility criteria and to conduct technical evaluations of received offers (and due diligence). While absence of these documents and/or information does not denote mandatory disqualification of suppliers, the lack of these items has the potential to severely and negatively impact the technical evaluation of an offer.
Documents Supporting the Eligibility Criteria:
- Must be registered in Nigeria with evidence of registration attached.
- Must have recognized bank account (Mercy Corps will make all payments in bank through bank transfers).
- Must have a Tax Identification Number (TIN) with evidence of registration with FIRS attached. (Note that Mercy Corps in Nigeria deducts withholding tax in accordance with government regulations.)
Documents to Conduct the Technical Evaluation and additional Due Diligence:
- Copy of documents that show evidence of rendering Internet services for international agencies in North East Nigeria (recommendation letters, service completion notes, Purchase Orders etc.)
- Copy of CV for technical person (Engineer/technician/Installer)
- Document showing service provider is based in Maiduguri or have technical support team covering Borno/North East

Tender Basis
- All offers shall be made in accordance with these instructions, and all documents requested should be furnished, including any required (but not limited to) supplier-specific information, technical specifications, drawings, bill of quantities, and/or delivery schedule. If any requested document is not furnished, a reason should be given for its omission in an exception sheet.
- No respondent should add, omit or change any item, term or condition herein.
- If suppliers have any additional requests and conditions, these shall be stipulated in an exception sheet.
- Each offeror may make one response only.
- Each offer shall be valid for the period of [180 days] from its date of submission.
- Suppliers should ensure that financial offers are devoid of calculation errors. If errors are identified during the evaluation process, the unit price will prevail. If there is ambiguity on the unit price, the Selection Committee may decide to disqualify the offer.
- Any requests for clarifications regarding the project that are not addressed in written documents must be presented to Mercy Corps in writing. The answer to any question raised in writing by any offeror will be issued to that offeror. In some cases Mercy Corps may choose to issue clarifications to all offerors. It is a condition of this tender that no clarification shall be deemed to supersede, contradict, add to or detract from the conditions hereof, unless made in writing as an Addendum to Tender and signed by Mercy Corps or its designated representative.
