Title: Invitation to Bid for Concession of Ekiti House, Wuse Abuja

Project Description
Ekiti House is situated in Wuse district, north-western part of Abuja. Key government and parastatal offices are in this district. Ekiti House is rectangular in shape and has an area length of 13.364 square meters. The building has three (3) structures. The first structure has seven floors which is used for office purposes, while the second structure has seven floors which serve residential purposes. The third structure has been converted to a hotel facility with 46 suites and 12 single rooms, halls, meeting rooms, restaurant, laundry, and ample parking space.

The bidding process includes the submission of proposals by competent companies for consideration to be selected as the Concessionaire that would enter into a Concession Agreement with the Government of Ekiti State (through Fountain Holdings Limited) for a period of fifteen (15) years, to renovate, repair, reconstruct, operate, and manage the property under agreed conditions.

Preamble
The Government of Ekiti State, through Fountain Holdings Limited has taken the decision to commercialize select state- owned enterprises as part of ongoing efforts to attract new investments, create jobs, and increase internally-generated revenue in the state.

The state government has engaged a Transaction Advisor to manage the privatisation process in line with extant Public Private Partnership Laws.

We now invite registered and reputable firms and companies to participate in the bidding process for the Ekiti House Concession Project.

Who May Apply




We are inviting registered and reputable companies with proven track records of quality service delivery. The prospective bidders must meet the following criteria:
  • Demonstrate adequate professional and technical qualifications, human resources, and other verifiable facilities needed to execute all the phases of the Project as appropriate.
  • Demonstrate financial capacity and the resources to manage the fiscal aspects of the Project and the record to sustain its financial requirements.
  • Demonstrate technical expertise and operational feasibility, record of compliance with environmental standards, and quality service delivery with measurable framework to ensure continuity.
  • Demonstrate appropriate managerial and organizational capacity, proven record of experience in similar projects.
  • Interested foreign companies would be required to demonstrate evidence of having a local partner that meets the criteria above as part of its submission.
  • Bidders must specify the category of their application on the front page of their tender application letter.
Pre-Qualification Requirements
  • Certificate of Incorporation (in Nigeria where applicable); Certified True Copies of Memorandum and Articles of Association.
  • Tender Application Letter on bidder’s letter headed paper, including name of authorised contact person(s), company full address, email address, telephone number, duly signed and sealed/stamped.
  • Company Tax Clearance Certificate for the past three (3) years (2020, 2019 & 2018) for Nigerian Companies and similar tax certification documents for foreign companies.
  • Company’s Safety, Health and Environment policies, including safety records for accidents, incidents, injuries and damages for the past five (5) years.
  • Evidence of Certainty of Business Integrity and pre-signed undertaking to strictly comply with Nigerian Anti-Corruption Laws in processing the bid and executing the contract if successful; Evidence of Special Control Unit Against Money Laundry (SCUML).
  • Evidence of Financial capability (i.e. Performance Bond to cover the volume of work required, Bank Guarantee and/or ability to establish an irrevocable letter of credit for the project,).
  • Bidders must submit a sworn affidavit to support action as follows:
    • To allow verification of all claims made in your submission.
    • To allow verification that your organization is not in receivership, nor subject to any form of insolvency, or bankruptcy proceeding, or the subject of any form of winding up petition or proceedings.
    • That your company does not have any director who has been convicted in any country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter.
    • To confirm whether any of the members of the Board of relevant committees of the Government of Ekiti State or Fountain Holdings is a former of present director. shareholder or has any pecuniary interest in your company.
    • That all information presented in your bid are true and correct in all particulars.
  • Any additional information relevant to enhance the Bid process.

  • All completed Bids should be sealed and submitted in Two (2) separate envelopes and should include ONE Original, ONE Hard Copy & ONE Electronic Copy (Flash Drive).
  • The application should be duly signed by the bidder’s authorized representative and clearly marked as “Invitation to Participate: Ekiti House Concession Bid".
  • All bids received would be unsealed and endorsed after the submission deadline in the presence of invited observers and bidders.
  • Due to the COVID-1 9 epidemic, all bidders are invited to attend the opening session of the bidding process that will hold virtually. Prior to the day scheduled for the opening of the bidding process, all bidders are to visit: www.ironcapital.africa/index.html#latestnews and click the hyperlink "Ekiti House Concession Bid" to complete and submit an online form as directed on the website.
  • You shall receive a confirmation email requesting for the submission of a scanned copy of the bidding company’s Tender Application Letter and/or any other information/document.
  • The access link to the virtual opening of the bidding process would be sent to the applicant’s email address after the expression of interest has been submitted and received by the Transaction Advisor.
  • The meeting details sent shall give the bidding company’s representative access to the Bid Opening Session.
  • Please note that only bids submitted and received before the deadline for submission will be opened.
Important Information
It is hereby noted as follows:
  • Late submissions will be rejected.
  • All submissions should be clearly arranged and numbered in the order listed above in a folder or binder.
  • All claims will be verified for authenticity.
  • Only the companies who submit the required information and meet the pre-qualification criteria will be contacted after evaluation.
  • The Transaction Advisor will deal directly with only authorized officers of the interested companies and not through any individual or agent.
  • All costs incurred by applicants during the bidding is the sole responsibility of their companies.
  • This tender process does not include any provision for transfer of assets.
  • Inspection of site commences from the date of this publication on TUESDAYS and THURSDAYS 12pm to 3pm) within the first three (3) weeks.
  • This pre-qualification process neither creates any commitment nor establishes any legal relationship with to the Project on the Transaction Advisor, the Government of Ekiti State Government, or its Agency.
  • There is currently a litigation in respect of the property which in the opinion of EKSG (i.e., FHL/the owner of the facility) the determination of the court case or otherwise will not have any material effects on this transaction.
  • All information shall be provided in English Language.
