The National Institute for Cultural Orientation (NICO) invites qualified, interested and eligible contractors to express interest by submitting tender documents for the following works:




The National Institute for Cultural Orientation (NICO) was established by Act 93 of 1993, as a joint initiative of the Nigerian Government and UNESCO during the World Decade for Cultural Development Programme (1988-1997), which emphasized the cultural dimension of development. The idea is also enunciated in the Cultural Policy for Nigeria (1988).

Title: Invitation to Tender for the Execution of the Capital and Constituency Projects Under the 2022 Appropriation Act

Preamble

The National Institute for Cultural Orientation (NICO) in furtherance of its statutory mandate intends to embark on the implementation of its 2022 Capital and Constituency Projects under various Works, Goods and Services for the financial year 2022 in accordance with the Public Procurement Act (PPA) 2007.

Accordingly, the Institute invites qualified, interested and eligible contractors to participate in the tendering process for procurement of Works, Goods and Services projects under the Institute's 2022 Appropriation as specified in the summary tables below and detailed in the solicitation Standard Bidding Documents to be collected from the Institute:

Eligibility Requirements
The general public may wish to be guided that all procurement activities of the Institute shall be fully governed by the Public Procurement Act (PPA) 2007 and the recent Federal Government Executive Order on Transparency and Support for Local Content in public procurement whereby the following minimum eligibility criteria should be submitted by all prospective bidders:
  • Certificate of Incorporation issued by Corporate Affairs Commission (CAC) with forms CO2, CO7 and Memorandum of Association. Business Name is also acceptable in case of Services;
  • Evidence of current Tax Clearance Certificate (or Personal Income Tax Clearance Certificate of all the Partners in case of Business Name) for the last (3) years (2019, 2020 and 2021) expiring on 31 December, 2022; reflecting the minimum average annual turnover as stated above
  • Evidence of Pension Clearance Certificate valid till 31 December, 2022 (this requirement is only applicable to bidders whose number of staff is 15 and above):
  • Evidence of Industrial Training Fund (ITF) Compliance Certificate valid til 31 December, 2022 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder's annual turnover is 150m and above):
  • Evidence of NSITF Compliance Certificate expiring on 31 December 2022
  • Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31 December. 2022 or valid Certificate issued by BPP:
  • Company's Audited Accounts for the last three (3) years - 2019, 2020 & 2021, duly acknowledged by the Federal Inland Revenue Service (FIRS), with average annual turnover corresponding to the turnovers in the Tax Clearance Certificate:
  • A Swom affidavit: - disclosing whether or not any officer of the relevant committees of National Institute for Cultural Orientation or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars - that no partner/director has been convicted in any country for criminal offences related to fraudulent or corrupt practices, or criminal misrepresentation or falsification of facts relating to any matter,
  • Reference Letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed:
  • Company's Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as COREN, QSRBN, ARCON, CORBON etc.);
  • Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects
  • For Services; Evidence of Firm's current registration with the Centre Management Development (CMD):
  • For construction: List of Plants and Equipment with proof of Ownership/Lease
  • For ICT jobs: Evidence of Firm's current registration with National Information Technology Development Agency (NITDA) and Computer Professionals Registration Council of Nigeria;
  • Only companies included in the National Automotive Design and Development Council's approved list of local manufacturers of vehicles or their authorised representatives should bid for the vehicles":
  • For Supply of Equipment: Letter of Authorisation as representative of the Original Equipment Manufacturers (OEMs)
  • For Joint Venture/Partnership. Memorandum of Understanding (MoU) duly registered in High Court should be provided (CAC, Tax Clearance Certificate, Pension Compliance Certificate, ITF Compliance Certificate, NSITF Compliance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner); Consortium of Firms is required.
  • All documents for submission must be transmitted to the Institute with a Covering/Forwarding letter under the Company/Firm's Letter Head Paper duly signed by the authorised officer of the firm bearing amongst others the Registration Number(RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM Number) and e-mail address. The letter Headed Paper must bear the Names and Nationalities of the Directors at the bottom of the page.

Opening of EOI and Technical Bids

The Eol and the Technical Bids will be opened immediately after the deadlines for submission at 12:00 noon on Monday, 30th May, 2022 at Boardroom 3 floor, National Institute for Cultural Orientation, 23, Kigoma Street Wuse Zone 7, Abuja, while the Financial bids will be kept un-opened. Please, ensure that you sign the EOV Bid Submission Register as the Institute (NICO) will not be held liable for misplaced or wrongly submitted bids.

Collection of Tender Documents (Category A & B)
A non-refundable tender fee of Ten Thousand Naira (N10,000.00) is payable by all bidders into the Federal Government Single Treasury Account (TSA) (National Institute for Cultural Orientation) with the following account details:

Interested bidders are to collect Standard Bidding Documents (SBD) from Second Floor. Procurement Unit, 23, Kigoma Street, Wuse Zone7, National Institute for Cultural Orientation Headquarters, Abuja, between 10am and 4pm upon presentation of evidence of payment of the tender fee.

Submission of Tender Documents (Category A & B)

Completed Technical and Financial bids (2 hard copies & 1 soft copy and the Soft Copies of Financial Bids must be in MS Excel) shall be submitted in two different sealed tamper proof envelopes and labelled "Technical Bid" and "Financial Bid' and both placed in a third envelope. The soft copies must not be scanned copies. All the three (3) envelopes should bear the Company's name at the reverse side while the "Project Name and Lot No. at the Top Right-Hand corner of the envelope and addressed to:

The documents should be deposited in the Tender Box at the Tender Secretariat, Procurement Unit Second Floor, NICO Qtrs. Abuja not later than the specified closing date.

Submission of EOI Documents (Category C)
Prospective firms are to submit EOI documents for each of the Lot desired; two (2) hard copies each of the EOI packaged in sealed envelopes and clearly marked as "Eor": and addressed as stated above and clearly marked with the name of the project and the Lot number). Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at the Tender Secretariat, Procurement Unit, Second Floor, NICO Qtrs. Abuja not later than the specified closing date.

Additional Information
Please note that:
  • Bids must be in English Language and signed by Official assigned by the bidder.
  • The Institute may verify any or all the claims made by applicants and shall disqualify any company whose claims are found to be false in addition to other sanctions that may be deemed necessary;
  • All costs incurred in responding to this advertisement shall be borne solely by the Bidders;
  • Bidders should not bid for more than two (2) Lots:
  • Non-compliance to the instructions in this advertisement and late submission of bid will lead to outright disqualification;
  • This advertisement shall not be construed as a commitment on the part of the Institute to award contract to any bidder,
