The Nigeria Integrated Water Resources Management Commission (NIWRMC) invites Interested, Eligible and Experienced Consulting Firms, Bidders / Suppliers of proven competence, to submit Expression of interest (EOI) or Tendering Documents for the following works:




The Nigeria Integrated Water Resources Management Commission (NIWRMC) is a unique Regulatory Organization, involving a partnership of the Federal, States, Local Governments and the Federal Capital Territory. The Mandate of the Commission shall be to regulate, protect, conserve and control Water Resources defined in this Law as the “National Water Resources” (Act 2004) for equitable and sustainable social and economic development, also to maintain the environmental integrity of the ecosystem.

Preamble

The Federal Government of Nigeria has allocated funds to the Nigeria Integrated Water Resources Management Commission (NIWRMC), in the 2022 Capital Appropriation Act, for the procurement of Consultancy Services, Works and Goods, aimed at achieving the Core mandate of the Commission.

In compliance with the provisions of the Public Procurement Act 2007, the Commission Invites Interested, Eligible and Experienced Consulting Firms, Bidders/Suppliers of proven competence, to submit Expression of interest (EOI) or Tendering Documents for the following Specialized Assignments, Works and Goods.

Eligible Requirements
The Consulting Firms wishing to express interest for the Specialized Consultancy Services, as well as Bidders for Works and Goods must possess the under listed requirements, to be eligible to participate at next stage of the bidding process:
  • Certificate of incorporation issued by Corporate Affairs Commission (CAC), Please attach the company's Article of Memorandum duly certified forms CO2 and 007. Business Name is also acceptable for Services;
  • Evidence of Company's income Tax Clearance Certificate (or Personal income Tax Clearance Certificate of all the Partners in case of Business Name) for the last three (3) years valid till 31 December, 2022; with minimum average annual turnover as contained in the RFP/Bidding Document:
  • Evidence of Pension Clearance Certificate valid till 31 December, 2022 (this requirement is only applicable to bidders whose staff is 15 and above).
  • Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31" December, 2022 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder's annual turnover is N5om and above);
  • Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31 December, 2022;
  • Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31 December, 2022 or valid Certificate issued by BPP:
  • Company Audited Accounts for the last three years (2019, 2020 & 2021)duly acknowledged by the Federal Inland Revenue Service (FIRS);
  • A Sworn Affidavit:
    • Disclosing whether or not any officer of the relevant committees of the Nigeria Integrated Water Resources Management Commission or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
    • That no Partner/Director has been convicted in any Country for criminal offences, related to fraudulent or corrupt practices, or criminal misrepresentation, or falsification of facts relating to any matter;
    • That the Company is not under receivership, the subject of any form of winding up petition or proceedings, insolvency or Bankruptcy
    • That the Commission is permitted the Commission to verify documented claims of past assignments and Company Documents, with Relevant Agencies;
  • Reference Letter from a reputable commercial bank, indicating willingness to provide credit facility for the execution of the project when the need arises;
  • Company's Profile with the Curriculum Vitae with Phone Numbers of key Technical Staff to be deployed for the Assignments/Works, including copies of their Relevant Academic/Professional qualifications (COREN QSRBN COMEG etc.), who may be contacted independently for further explanation on the Bidders' submission
  • Verifiable documentary evidence of at least three (3) similar Jobs/Assignments executed in the last five (5) years including Letters of Awards, Job Completion Certificates and Photographs of the Assignments,
  • Works: List of Plants/Equipment with proof of Ownership/Lease;
  • Services: Evidence of Firm's current registration with relevant regulatory professional body(ies) such as COREN, ICAN, ANAN etc.;
  • For Supply of Equipment: Letter of Authorisation as representative of the Original Equipment Manufacturers (OEMs):
  • For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each IV partner);
  • All documents for submission must be transmitted with a Covering/Forwarding letter on the Company/Firm's letter Head, bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The letterhead must also bear the Names and Phone numbers of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

Opening of EOI and Technical Bids

The Expression of Interest (EOI), will be opened immediately after the deadline of 12:00 noon on Thursday, 12" May, 2022, at the Commission's Conference Room on the 2 Floor. The Technical Bids for Goods& Works will be opened immediately after the deadline of 12:00 noon on Wednesday, 1 June, 2022, at the same venue, while the financial bids will be kept un-opened.

Collection of Tender Documents (Goods & Works)
Bidders are to pay the sum of Ten Thousand Naira (N10,000) per Lot only through the Nigeria Integrated Water Resources Management Commission (NIWRMC)'s Remita Platform before obtaining Biding Documents from the Procurement on the First Floor, Room 9. Firms Interested in Services will not pay at this stage until after shortlisting.

Submission of Tender Documents
Prospective Bidders for Category A (Consultancy Services) are to submit Expression of interest (EOI), in Two (2) hard copies of the Technical (Original and Photocopy), in sealed envelope, with Lot Number and Company Address clearly written on one (1) side of the Envelope and the Commission's Address on the other side.

The Technical and Financial Bids should be submitted in Two (2) copies, (Original and Photocopy), in sealed Separate Envelopes, enclosed in a bigger Envelope, with Lot Number and Company Address clearly written on one (1) side of the Envelope and the Commission's Address on the other side. All the submission of Bids/Eol are to be made at the First Floor, Room F9 in Designated Boxes.

Please, ensure that you sign the Bid Submission Register at the office of Head of Procurement, Room F9, 1" Floor, as the Commission will not be held liable for any misplaced or wrongly submitted bid documents.

General Information
  • Suitability of Expression of Interest to the Assignment is of essence. (showing Understanding of the Assignments under process) Category A
  • All Expression of interest/Blds must be in English Language and duly signed by an authorised Official
  • Both Expression of Interest or Bids submitted after the deadline would be returned un-opened,
  • Bidders should not bid for more than one (1) Lot;
  • Presence of bidders/representatives and members of the public shall not be required during the bid opening ceremony in compliance with COVID-19 Guidelines. The Bids Opening will be covered by video recording invitation link will be sent to bidders to join the bid opening online) with the physical presence of two (2) representatives of private sector professional bodies and Civil Society Organisation in the areas of Anti-Corruption/Transparency:
  • Bid documents can also be collected in soft copies and Bidders can submit through Post Courier Services:
  • Goods & Works: Only pre-qualified bidders at technical evaluation will be invited at a later date for virtual financial bids opening while the financial bids of un-successful bidders will be returned un-opened;
  • Services: Only shortlisted firms will be invited at a later date for collection of Request for Proposals:
  • The Nigeria Integrated Water Resources Management Commission is not bound to pre-qualify any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
